These terms supplement the general marketplace terms for members who sell.
1. Becoming a Seller
- The seller is of legal age and domiciled (or has their registered office) in Switzerland.
- They verify their identity once before publishing: an identity document and a selfie, checked by our provider Didit. BDPokéCards only retains the verification result (verified or refused, and its date), not the documents.
- They then choose how they are paid (see Article 7): online, directly, or both.
2. Private and Professional Sellers
The seller indicates whether they are selling privately or professionally. A professional seller provides their business name and UID number; they can offer multiple identical items in a single listing (up to 99) and comply with the legal obligations applicable to professionals (warranty, VAT, consumer information). A person who sells regularly for profit must declare themselves as a professional.
3. New Sellers and Badges
Until 3 completed sales, a seller is considered new: they can have a maximum of 20 listings online, and any listing over 500 CHF is verified by the team before publication.
The "verified seller" badge is awarded to a seller who meets: 10 completed sales, at least 5 reviews with an average of 4.5 out of 5 or more, no more than 5% lost disputes, and an account open for at least 60 days. It is removed if these conditions are no longer met.
4. Listings
The seller:
- owns the item and keeps it available for the duration of the listing;
- publishes actual photos of the item being sold, front and back (never images taken from the Internet);
- honestly describes the condition of the item and notes any defects (crease, scratch, wear, centring, printing);
- specifies the exact language and variant of a card and, for a graded card, the company, grade, and certificate number, with photos of the case;
- does not include any contact details in the listing or in their responses.
If the item is sold elsewhere, the seller immediately removes their listing. A sale concluded on the marketplace must be honoured. The reference price suggested when creating the listing is purely indicative.
5. Shipping Methods and Postage Costs
For each listing, the seller chooses the shipping methods offered: the preset methods of La Poste for Switzerland and to France, or their own. The postage costs correspond to the actual cost of shipping and reasonable packaging. Tracked shipping is mandatory from 100 CHF. In-person delivery is free; the buyer can then also pay in cash.
6. After the Sale
- Ship the item within 5 days following payment, well protected, and provide the tracking number if there is one.
- Direct payment: confirm on the order that the money has been received only once it is in their account, then ship. Without payment by the deadline, the seller can cancel the sale.
- Respond to a reported issue within 3 days.
- If the sale cannot be honoured (item lost or damaged before shipping), inform the buyer and the team without delay: the buyer is fully refunded.
Unhonoured sales, repeated cancellations, and false payment confirmations can lead to limitation, suspension, or exclusion.
7. Payment Methods and Transfers
The seller accepts at least one of the following methods and can change it at any time from their account:
- Online payment (Stripe): the seller opens a Stripe Connect payment account. Stripe verifies the information required by regulations and the bank account (IBAN); BDPokéCards does not retain this information. Payment services are provided by Stripe and subject to the Stripe Connected Account Agreement, which the seller accepts when opening their account. The seller's share (price and postage costs, minus sales fees) is transferred to their Stripe account as soon as the buyer's payment is confirmed, then to their bank account according to their Stripe payout schedule.
- Direct payment (bank transfer or TWINT): the seller provides an IBAN and/or a TWINT number, communicated to their buyers on their orders. The buyer pays them directly; BDPokéCards does not collect anything.
If a refund is granted after an online payment, or if a chargeback is lost, the corresponding amount is deducted from the seller's Stripe account, if necessary from their subsequent payouts. For a direct or cash payment, the seller refunds the buyer themselves when a refund is decided. In case of suspected fraud, payouts may be frozen during verification.
8. Fees
Sales fees are 5% of the item's price, with no minimum, nothing on postage costs. The official BDPokéCards seller does not pay them.
Fees from sales paid directly or in cash cannot be deducted from a payout. They are recorded in the "Fees" section of the seller's account:
- On the 1st of each month, the previous month's fees are grouped into a fee invoice, payable within 30 days. No invoice is issued under 1 CHF: fees are carried over to the next month.
- As soon as unbilled fees reach 200 CHF, an invoice is issued immediately, and cash sales are suspended until payment.
- Payment is made online from the "Fees" section, or by bank transfer on request.
- Reminders are sent 7 days and 1 day before the due date. The day after the due date, the seller can no longer publish new listings or offer cash sales; ongoing sales and auctions continue.
- After 30 days of delay, the seller's fixed-price listings are suspended, and their account is restricted. BDPokéCards may withhold overdue fees from payouts of online-paid sales.
- Payment automatically lifts these blocks. Deadlines and the threshold may be adjusted by BDPokéCards; sellers are informed.
9. Taxes and Legal Obligations
The seller is solely responsible for their tax and social obligations related to their sales (income declaration, VAT for liable professionals). BDPokéCards may be required to provide information to the competent authorities.
10. Ending Seller Activity
The seller can stop selling at any time by removing their listings. Ongoing sales must be completed, and any fees due must be settled.
